Terms of Service

1. Acceptance of Terms
By accessing and using the Brickwise platform at brickwise.com.au (“the Service”), you agree to be bound by these Terms of Service (“Terms”). These Terms form a binding agreement between you and Brickwise Pty Ltd (ABN pending) (“Brickwise”, “we”, “our”, “us”). If you do not agree to these Terms, please do not use the Service.
2. Australian Consumer Law Guarantees
CONSUMER GUARANTEES
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or any other right or remedy you may have under the Competition and Consumer Act 2010 (Cth) or any other applicable Australian law that cannot be excluded, restricted, or modified by agreement.
3. Service Description
Brickwise provides an investment readiness assessment tool and personalised report generation service for Australian property investors. The Service includes a guided questionnaire, financial calculations, strategy recommendations, suburb suggestions, AI-generated narrative content, market data dashboards, and portfolio tracking tools.

Brickwise does not hold an Australian Financial Services Licence (AFSL) and is not authorised to provide personal financial product advice under the Corporations Act 2001 (Cth). Nothing on this platform constitutes a recommendation to buy, sell, or hold any financial product, nor is it intended to influence you in making a decision in relation to a financial product or class of financial products.
Brickwise does not lend money, arrange loans, or act as a credit intermediary.
You should always seek independent professional advice from a qualified and licensed financial adviser, mortgage broker, tax agent, or legal practitioner before making any investment decisions.
5. Pricing and Subscription Terms
Brickwise offers the following paid products:
- Investment Readiness Report: A one-time purchase of $49 AUD (inclusive of GST)
- Brickwise Pro subscription: $29 AUD per month (inclusive of GST), providing access to scenario modelling, suburb tracking, market alerts, and additional premium features
All prices are in Australian dollars and include GST where applicable. Payments are processed securely through Stripe. You can manage your subscription, update payment details, or cancel at any time through the Stripe Customer Portal accessible from your account settings.
Pro subscription terms:
- Your Pro subscription renews automatically each month until cancelled
- You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period, and you will retain access to Pro features until that date
- We will not charge you after your cancellation takes effect
- We reserve the right to change subscription pricing with 30 days' written notice. Existing subscribers will be given the option to continue at the existing price for the remainder of their current billing cycle
6. Refund Policy
We offer a full refund within 7 days of purchase for the Investment Readiness Report if you are not satisfied. To request a refund, contact us at support@brickwise.com.au with your order details. Refunds will be processed to your original payment method within 5–10 business days.
For Pro subscriptions, you will not be charged after cancellation takes effect. Refunds for the current billing period are available on a case-by-case basis. This refund policy does not limit your rights under the Australian Consumer Law (see Section 2).
7. AI-Generated Content
Portions of the Investment Readiness Report and other content on this platform are generated using artificial intelligence (Google Gemini). While we design prompts carefully and review outputs for quality, AI-generated content may occasionally contain inaccuracies or generalisations. All numerical data in reports comes from our deterministic calculation engine, not from AI. The AI generates narrative explanations, educational context, and market commentary only. AI-generated content is provided for general informational purposes and should not be relied upon as professional advice.
8. Broker Referrals and Affiliate Arrangements
Brickwise may introduce you to third-party mortgage brokers or buyers' agents where you have expressly opted in to receive an introduction. Brickwise may receive a referral fee or commission from these third parties. Any such referral fee does not increase the cost of services to you. The availability of broker introductions does not constitute a recommendation of any particular broker or financial product. You are under no obligation to engage with any introduced broker.
9. Accuracy of Calculations and Data
While we make every effort to ensure our borrowing capacity calculations and projections are based on current lending standards and APRA guidelines, these are estimates only. Actual borrowing capacity depends on individual circumstances assessed by a licensed lender. Property values, rental yields, growth rates, and other market data are based on historical information and publicly available sources, and may not reflect current conditions. 10. Your Responsibilities
- You must provide accurate financial information in the questionnaire. Inaccurate inputs will produce inaccurate results
- You must not use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account
- You must not attempt to reverse-engineer, scrape, or automate access to the Service, nor attempt to gain unauthorised access to any part of the Service or its related systems
- You must be at least 18 years of age to use the Service
11. Intellectual Property
All content, calculations, algorithms, design elements, trade marks, and other intellectual property of the Brickwise platform are owned by or licensed to Brickwise Pty Ltd. Your purchased report is licensed for your personal, non-commercial use only and may not be redistributed, resold, or published without our prior written consent.
You retain ownership of the personal information and data you provide to us. By using the Service, you grant us a limited licence to use that data for the purposes described in these Terms and our Privacy Policy.
12. Limitation of Liability
Subject to Section 2 (Australian Consumer Law Guarantees) and to the maximum extent permitted by law:
- Brickwise and its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive loss or damage arising from your use of the Service or reliance on information provided, including but not limited to financial loss from investment decisions
- Our total aggregate liability to you for any claim arising under or in connection with these Terms is limited to the total amount you have paid to us in the 12 months preceding the claim
- This limitation does not apply to liability that cannot be excluded or limited under applicable Australian law, including the Australian Consumer Law
13. Termination
Your right to terminate: You may close your account and stop using the Service at any time. If you have an active Pro subscription, cancellation takes effect at the end of your current billing period. You may also request deletion of your personal data in accordance with our Privacy Policy.
Our right to terminate: We may suspend or terminate your access to the Service if you materially breach these Terms and fail to remedy the breach within 14 days of receiving written notice from us, or if you engage in conduct that is unlawful, abusive, or harmful to other users or our systems. Where we terminate for cause, we will provide you with a pro-rata refund of any prepaid subscription fees for the unused portion of your billing period.
14. Dispute Resolution
If a dispute arises in connection with these Terms, the parties agree to follow this process before commencing court proceedings:
- Step 1 — Notification: The party raising the dispute must notify the other party in writing, setting out the nature of the dispute and the outcome sought
- Step 2 — Negotiation: The parties will use their best efforts to resolve the dispute through good faith negotiation within 21 days of the notification
- Step 3 — Mediation: If the dispute is not resolved through negotiation, either party may refer the dispute to mediation administered by the Australian Disputes Centre (ADC) in Sydney, NSW. The costs of mediation will be shared equally
- Step 4 — Court proceedings: If the dispute remains unresolved after mediation, either party may commence court proceedings
Nothing in this clause prevents either party from seeking urgent interlocutory relief from a court of competent jurisdiction.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Each party irrevocably submits to the non-exclusive jurisdiction of the courts of New South Wales and any courts competent to hear appeals from those courts.
16. Unfair Contract Terms
We have drafted these Terms to be fair and balanced in accordance with the unfair contract terms provisions of the Australian Consumer Law (as amended November 2023). If any term is found to be unfair within the meaning of sections 23–28 of the Competition and Consumer Act 2010 (Cth), that term is void and the remainder of these Terms continue to apply.
17. Changes to These Terms
We may update these Terms from time to time. Where changes are material, we will notify you by email or by prominent notice on our website at least 14 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you may terminate your account in accordance with Section 13.
18. Severability
If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
